Last year, in Koontz v. St. Johns River Mgmt. Dist., the United States Supreme Court reaffirmed that the Takings Clause of the Constitution bars government from using the permit process to make extortionate demands from owners and developers. Now, 18 months later, we review the impact of Koontz on land use permitting — what issues that have been resolved and what issues remain in dispute.
